Facts: Our client, RC, who is a certified public accountant, hired us to defend him against a complaint filed with the Board in connection with a civil lawsuit judgment unrelated to his practice as an accountant. RC was facing a serious threat to his professional reputation, harm to his ability to obtain work from clients, the prospect of significant discipline from the Board and harm to his livelihood based on the groundless efforts by the Board to discipline RC based on this civil judgment.

Outcome: Bertolino LLP collected and assessed RC’s material related to the civil judgment so we could demonstrate the Board did not have grounds to take discipline. Bertolino LLP advocated aggressively for RC, submitting legal argument to the Board demonstrating the case had to be dismissed because it lacked merit. We explained why RC had not violated state law and that this complaint had to be dropped. Based on these successful arguments, the Board dismissed RC’s complaint in full and took no discipline against him whatsoever. As a result, RC’s professional reputation and livelihood were protected from a groundless complaint.
