Facts: Our client B.C., was reported by a former student alleging that he spoke to her about inappropriate and sexually explicit topics and made her feel so uncomfortable that she had to leave in-person learning and revert back to remote learning.
Outcome: After the Board’s investigation, an informal settlement conference was held. Bertolino LLP presented evidence that showed that the student’s report was not credible and that it was actually the student that made our client feel uncomfortable. We presented argument that the student had developed feeling for our client and when our client began to distance himself from the student, she retaliated by reporting him. We also provided testimony that the inappropriate and sexually explicit topics the student disclosed in her report were actually brought up by the student herself. After considering our evidence and defenses, the Board dismissed the matter.
