Outcome: During an informal conference in front of a board panel, BERTOLINO LLP argued that the alleged patient was never a patient of SM. The patient was a former patient of SM’s employer. However, when the patient and SM met, she was no longer even a patient of the employer. SM did not know her as a patient, and we provided a statement from the patient stating that she was never under treatment by SM and her relationship with SM never impacted her treatment. We also provided evidence showing that the complaint itself was submitted by SM’s ex-wife in retaliation of recent divorce proceedings. After the conference, the panel agreed to dismiss the matter after SM completed 6 hours in CE. SM completed the 6 hours, and her matter was dismissed.
