Due Process of Law

Licensing boards and state agencies have a duty to give you due process of law, guaranteeing you the opportunity to defend your professional license. However, there are instances when a license can be suspended prior to due process. For example, the Texas Medical Board (TMB) may issue a Temporary Suspension Order to stop a physician from practicing medicine immediately.

To issue a Temporary Suspension Order the Board must determine that the physician's practice is a continuing threat to patients or to the public. TMB temporary suspension hearings may be held without notice to the physician, but must be followed afterward by another hearing giving proper notice to the physician.

In any case, to permanently revoke a medical license the TMB must either file the case with the State Office of Administrative Hearings (SOAH) or get the licensee to sign an Agreed Order surrendering the license.

Consequences of License Revocation, Suspension, or Probation

If your license is suspended or revoked, it means that you will not legally be able to perform your job. Your livelihood will be gone. If your license is put on probation, it means you will have restrictions on your license, possibly heightened oversight, and with any misstep you are likely to have your license suspended or revoked.

A license suspension or probation period lasts for a defined amount of time. A license revocation may be indefinite.

Revocations, suspensions, and probation periods typically become public record. Future employers, prospective clients/patients, and insurance companies will have access to information regarding the disciplinary action taken against you. This could impact you for the remainder of your career.
