The Texas State Board of Social Worker Examiners (TSBSWE) regulates the profession of social work in Texas. It operates under the Texas Health and Human Services Commission as of September 1, 2017. The Board is responsible for establishing policy and ensuring an effective social worker regulatory program, with the primary purpose “to protect and promote the health, safety, and welfare of the citizens of Texas.”
The Board is also tasked with investigating complaints made against Texas Licensed Social Workers.
Texas State Board of Social Worker Examiners Complaint Process
If a complaint is filed against you alleging that you have violated Social Worker licensing regulations, you will be notified by the board and given an opportunity to formally respond.
The Board then investigates the complaint. It will gather pertinent documents and contact all parties who may have relevant information. Once the investigation is completed, a report is given to the Ethics Committee of the Board, which will determine whether a violation of licensing regulations has been proven.
If the Ethics Committee determines that a violation occurred, the Board may issue a letter of reprimand, impose probation, or it may deny, suspend, or revoke your license.
Your Rights During the Complaint Process
If the Board takes an adverse action against your license, you have the right to request an administrative review. If you are not satisfied with the results of the administrative review you have the right to a hearing before the Texas State Office of Administrative Hearing (SOHA). A SOHA hearing is conducted by an Administrative Law Judge and operates similarly to a courtroom trial, whereby you may present evidence, call witnesses, and cross-examine witnesses called by the Board.
