Texas law allows for licensing organizations to deny issuing or renewing your professional license if you fall behind on student loan payments. Failure to pay child support payments can lead to suspension or non-renewal of your professional license and even your Texas driver’s license.
Texas doctors, nurses, attorneys, CPA’s, teachers, and many other professionals are at risk of losing their professional licenses due to the laws on unpaid debt and licensure. The Texas Education Agency reports that nearly 250 teachers’ applications for license renewal were denied based on defaulted student loan payments over the course of five years. Based on records from multiple state agencies, the Texas Tribune found more than 4,200 people in Texas, including pharmacists, security guards, and cosmetologists, are at risk of losing their professional licenses because of student loan default.
Some state lawmakers are advocating for amending the law. Proponents of change argue that the draconian law is harmful to the lives of Texans and the State’s economy. The House Freedom Caucus, chaired by Rep. Matt Schaefer said in a statement, “Students should be responsible for repaying their debts, but taking away one’s ability to earn money in a licensed profession only exacerbates the problem.” The Caucus argues that the Legislature needs to “address this issue head on and ensure that Texans who can’t pay student loans aren’t further crippled by government actions.”
While the debate continues, currently it is Texas law that if you fall behind on certain types of debt payments you will be unable to obtain or maintain your professional license.
