The Texas State Board of Pharmacy (TSBP) received 6,146 complaints in fiscal year 2016, a 4% increase over the 5,925 complaints it received in fiscal year 2015. The TSBP reviews and evaluates every complaint it receives. Complaints are referred to a TSPB investigator when it is determined that the allegations, if true, would constitute a violation of the Texas Pharmacy Act or Texas Drug Laws.
The TSBP is responsible for the licensing and regulation of Texas pharmacists, pharmacy technicians, and pharmacies. It is also responsible for resolving complaints and disciplining licensees for violations of law. Complaints are resolved with either a verbal or written warning, or with disciplinary action taken against the licensee. Disciplinary action can involve a reprimand, fines, suspension, or license revocation.
Texas Pharmacist License Defense
When a disciplinary action is initiated against you based on a TSBP complaint, you will have an opportunity to attend an informal settlement conference. This gives you the opportunity to show compliance with the law. After the settlement conference, a panel comprised of Board staff or Board members will then propose a recommendation for settlement of the case, including any sanctions.
You will be given the opportunity to accept or reject the proposed Agreed Board Order. In fiscal year 2016 approximately 98% of the disciplinary cases against pharmacists and pharmacies, and 99% of the cases against pharmacy technicians, were settled through the entry of Agreed Board Orders (or Default Board Orders). Another 2% were settled with the entry of Remedial Plans.
