The Texas State Board of Pharmacy (TSBP) is the state agency responsible for the licensing and registration of Texas pharmacists, pharmacy technicians, and pharmacies, and for disciplining licensees and registrants. The TSBP received 5,925 complaints in fiscal year 2015, up from 5,561 in fiscal year 2014. Every complaint is reviewed and evaluated. If it is determined that the allegations, if true, would constitute a violation of the Texas Pharmacy Act or Texas Drug Laws, then the complaint may be referred to a TSPB investigator.
Complaints are resolved with either a verbal or written warning, or with disciplinary action taken against the licensee. Disciplinary action may include reprimand, fines, suspension, and license revocation.  During all states of the investigation, any person licensed by the TSPB has the right to be represented by an attorney.
Informal Settlement Conference
When a disciplinary action is initiated, the licensee will have an opportunity to attend an informal settlement conference. This gives the accused the chance to show compliance with the law. A panel comprised of Board staff or Board members will then propose a recommendation for settlement of the case, including any sanctions. If the licensee accepts the recommendation (the proposed Agreed Board Order) then it is presented to the Board at its next regularly scheduled meeting.
If, however, the licensee does not accept the proposed Order, or the Board rejects it, the case will proceed to a public hearing conducted by an Administrative Law Judge (ALJ).
