In March 2017, the Texas Medical Board acted against "the Drive Thru Doc," Dr. Courtney Morgan, a Victoria, Texas, family medicine physician. Criminal charges alleging that the doctor ran an illegal “pill mill” were dismissed in January 2017. Yet, Victoria Advocate recently reported that the Texas Medical Board (TMB) has given Morgan ten-years of probation for malfeasance relating to his two Victoria medical clinics, Drive Thru Doc and Hop Medical Services. (A related civil lawsuit is still ongoing.)
On March 3, 2017, the TMB issued a Final Order against Morgan for numerous violations. The Board found that Morgan had failed to register Hop Medical Services as a pain management clinic and failed to properly document his treatment for several patients, and he'd failed to properly secure official prescription blanks. Additionally, the TMB determined that he'd prescribed phentermine to himself for longer than the 72-hour limit permitted by Texas law.
While the TMB concluded that the physician’s actions involved multiple patients and increased potential harm to the public, the TMB conceded that no evidence of actual harm to a patient had come to light, and Morgan was willing and able to undergo rehabilitation.
Consequently, the TMB revoked Morgan’s license but stayed the revocation for ten years. If Morgan fulfills a series of requirements, he can retain his medical license. If he fails to do so, his license will be revoked.
Included in these requirements, Morgan must surrender his DEA controlled substances registration. He must also restrict his practice to group or institutional settings, and he cannot treat pain patients for five years. He must complete at least 24 hours of continuing medical education.
License restrictions, suspension or revocation are among the possible negative outcomes of allegations against your professional license, but they are not inevitable.
