Houston Wrongful Termination Attorneys
If you are employed in the state of Texas, you need to know that our state laws are not particularly favorable to an employee who believes that he was terminated from a job unfairly. Texas is a state that operates under the concept of "employment at will," which means that, in most instances, an employee can be fired without warning and without cause. There does not need to be any reason given for your termination. However, there are circumstances for which you cannot lose your job and an experienced employment attorney will work with you to defend your rights in the workplace. Were you fired after requesting time off to care for your newborn? Did your employer ask you to keep quiet about illegal practices that you witnessed at your company? Were you called into your employer's office the same day that you overheard him saying that he was going to find a way to fire of all the African American workers? In these instances and many others, you may have a legitimate case of wrongful termination.
There are legal protections in place for workers under both the Chapter 21 of the Texas Labor Code and Title VII of the Civil Rights Act of 1964. You cannot face adverse effects to your employment status for any of the following reasons:
• Your race, color, national origin, religion, sex, or age (with certain exceptions)
• Disabilities that are covered under the Americans with Disabilities Act
• Requesting unpaid leave as warranted by the Family and Medical Leave Act (FMLA)
• Reporting acts of fraud or violations at your place of employment
• Your contract explicitly states only certain reasons that you can be fired
• Refusing to commit an illegal act on behalf of your employer
If you believe that you were fired from your job for a reason that is explicitly protected by state and/ore federal law, you will want to file a formal complaint with the Equal Employment Opportunity Commission (EEOC) and/or the Texas Workforce Commission Civil Rights Division within 180 days of the alleged wrongdoing. Having an attorney by your side will ensure that you are securing all of the necessary documentation and witnesses. If your case eventually lands in federal or state court, you certainly will want legal counsel by your side through that process as well.
