Adjustment of status is the final step to obtain a green card under US federal immigration law. An immigration applicant, with the assistance from a capable immigration attorney, can best apply for permanent residency in the following situations:

  • a spouse of a US citizen;
  • a relative of a US citizen or permanent resident whose priority date is current;
  • a fiancé(e) who entered the US on a K1 visa;
  • an beneficiary of an approved asylum petition;
  • the spouse or child of an abusive permanent resident or US citizen;
  • an individual who wants to file an employment based petition or is the beneficiary of an already approved employment based immigration petition such as EB1-EA, EB1-OR, EB1-ET, EB2, National Interest Waiver, EB3, EB4 or EB5 petition;
  • Green card lottery winners currently in the US; and
  • a continuous resident of the US since before January 1, 1972.

An adjustment of status applicant may, at the time the adjustment application is prepared and filed by an experienced immigration lawyer, apply for a work permit. In addition, adjustment of status application is appropriate for foreign nationals with an approved immigrant petition. It is also appropriate for applicants who have an immigrant visa number immediately available and are filing an immigrant petition and are currently residing in the United States.

There are particular requirements for obtaining an adjustment of status under federal immigration law. An immigration lawyer can assist a foreign national with applying for adjustment of status if an immigrant visa number is available to you based on an approved immigrant petition; if your immigrant petition were approved then an immigrant visa number is immediately available; and the immigration applicant is not otherwise deemed ineligible by the virtue of failing to maintain your nonimmigrant status, employed without authorization, or other reason.
