Removal proceedings are the court hearings in which an Immigration Judge decides whether an alien will be prevented from entering or remaining in the United States. Removal proceedings are similar to criminal trials. The removal hearing is preceded by an investigation and sometimes arrest. A removal proceeding may conclude with an order of termination, relief from removal or removal. An appeal of a order for removal is possible.

The Removal or deportation process affects foreign nationals whom the USCIS is trying to deport from the country.

There are particular requirements for avoiding Removal or Deportation.  The US Immigration and Customs Enforcement (ICE) has discretion as to whether they will try to remove an alien. Many times they will choose not to act or will allow the alien to voluntarily depart from the United States. However, if the ICE chooses to try to remove the alien, the alien has several options to prevent removal. Many types of relief are discretionary and require the judge to weigh numerous factors. It is imperative to have a competent attorney to argue vociferously on your behalf to prevent being removed.
